General terms and conditions
1. contract conclusion
With the binding booking of an apartment or house, which can be made via the Internet, but also in writing or by telephone, a corresponding contract is concluded. The accommodation is rented to the tenant for the specified contract period exclusively for use for vacation purposes.
2. booking restrictions
All accommodations have a 1 night pre-booking restriction.
The minimum stay of the apartment Sunny is 3 nights.
The minimum stay of the house Relax is 4 nights.
3. payment of the contract price
The respective travel price is to be paid in full, directly and via the respective payment service provider at the time of booking.
Bei Auslandsüberweisungen gehen die Transferkosten zulasten des Gastes.
4. deposit / down payment
None of the accommodations require a deposit or down payment.
5. arrival/departure
Die Ferienunterkünfte stehen am Anreisetag ab 15:00 Uhr bzw. nach Absprache zur Verfügung. Am Abreisetag sind die Ferienunterkünfte bis 11:00 Uhr bzw. nach Absprache in einem ordnungsgemäßen, gereinigten Zustand (Endreinigung ausgenommen) zurückzugeben.
The early departure of the guest, which must be reported to the host, does not entitle the latter to assert claims for restitution or damages. The guest also owes the agreed rent for this case.
6. key
The keys will be handed over personally by the host on the day of arrival.
The keys will be returned on the day of departure either personally to the host or as otherwise agreed.
If a key is lost, this must be reported immediately. The costs for the necessary replacement of the locking system are to be borne by the guest.
7. guests
The respective accommodation is provided only for the contractually agreed persons according to the booking. Subsequent changes require the permission of the host. This applies in particular to overnight stays of additional persons. In case of violations, the host is entitled to expel the persons not listed in the booking from the vacation property.
8. Haustiere & Rauchen
Bringing pets is not allowed in any of the accommodations. This also applies to visitors of the guests. Smoking is generally not allowed inside the accommodation premises.
9. obligations of the tenant
The guest/guests undertake to treat the entire premises including inventory with care and to protect them from any damage. Damage to the accommodation and on the residential property or shortages to the inventory occurring during the rental period must be compensated by the tenant, unless he can prove that he himself or the persons accompanying him are not at fault for the occurrence of the damage or the shortage.
The guest must immediately inform the host of any incompleteness of the inventory or existing or occurring defects in the accommodation, otherwise the host is entitled to compensation claims based on this.
10. Pflichten des Gastgebers
With the effective conclusion of the contract, the host is obliged to provide and hand over the accommodation in accordance with the contract. If, despite all due care by the host, circumstances beyond the host's control (storm disasters, fire, explosion, damage to the house, vandalism, etc.), the accommodation cannot be used by the guest as agreed, the host is liable exclusively in the amount of the agreed and paid accommodation price.
11. cancellation fees/non-utilization
Bookings cancelled at least 30 days before the beginning of the stay will be fully refunded. Bookings cancelled at least 14 days before the start of the stay will be refunded at 50%. Cancellations of 13 days or less will be charged the full tour price.
The guest is obligated to pay 90% of the travel price, minus the saved expenses, if the contractual services are not used.
The conclusion of a travel cancellation insurance is recommended to the tenant.
12. wifi usage
12.1 Der Gastgeber unterhält in seinen Unterkünften einen Internetzugang über WLAN. Die Zugangsinformationen erhält der Mieter bei Anreise vom Gastgeber. Er gestattet dem Mieter für die Dauer seines Aufenthaltes im Mietobjekt eine Mitbenutzung des WLAN-Zugangs.
12.2 Sollte der Vermieter Kenntnis über die rechtswidrige Nutzung des WLAN-Zugangs durch den Mieter erlangen, wird er die Mitnutzung des Mieters umgehend ausschließen und die Behörden über den Missbrauch informieren.
12.3 Der Gastgeber haftet dem Mieter gegenüber für Störungen des WLAN-Zugangs nicht. Der Gastgeber ist berechtigt, den Nutzungsumfang des WLAN-Zugangs des Mieters jederzeit einzuschränken.
12.4 Der Gastgeber übernimmt keine Haftung für eventuelle Schäden (Malware o. ä.), die durch die Nutzung des WLAN-Zugangs entstehen. Der Mieter hat eigenständig für die Sicherheit seiner Daten zu sorgen.
12.5 Werden durch den Mieter über das WLAN kostenpflichtige Dienstleistungen o. ä. in Anspruch genommen, übernimmt er hierfür vollumfänglich die anfallenden Kosten.
13. amendments to the contract
Subsidiary agreements, amendments and supplements to the contract as well as all legally relevant declarations must be made in writing.
14. severability clause
Should individual provisions of this contract be or become invalid in whole or in part, or should there be a gap in the contract, this shall not affect the validity of the remaining provisions. In place of the invalid provision or to fill the gap, an appropriate provision shall be made which, as far as legally possible, comes as close as possible to what the contracting parties intended or would have intended according to the sense and purpose of this contract if they had considered the point.
15. place of jurisdiction
Any disputes arising from the contractual relationship shall be subject to the jurisdiction of the competent local court or regional court belonging to the judicial district of the place of performance.
